Hi peeps, Was just told about this today and was looking through news online and came accross it myself. I mean who in there right mind walks into a class half way through ? I wouldnt. €38,0000 hahahaha. It makes me laugh actually that it comes back to the big bad word "RECESSION", people jumping on the band wagon for easy cash. If she walks into an aerobics class pulls a calf muscle and then is ok after 5 weeks thinks to herself ah sure yeah "it's the gyms fault" . I just though I would share that with you all.

Very few such cases have been successful in Ireland under the pretext that all sports and fitness activities carry a degree of 'acceptible risk' meaning that the instructor would have to be negligent and this would have to be backed up by another expert in the field. Imagine suing somebody who was trying to get you fit because you pull a muscle, peculiar mentality if you ask me.

yea its defo a case of someone looking for easy money , im gald she got stung with the cost aswell , she is an adult after all and if she really thought it was that bad she would have stopped, rest it and then get a lift home. and as declan said there is a risk of pulling muscles and injuries if your doin any physical activities and if its not stiff and sore your not doin enough

Great to see common sense prevailing in the court rooms for once. What part of "complete recovery" justifies any compensation let alone 38k? I agree, it looks like she was trying to make a quick buck or clear some debts to me.
